AusPATH Statement on UK Bell v Tavistock Appeal Decision

The Australian Professional Association for Trans Health (AusPATH) was established in 2009 and is the national peak body representing, supporting, and connecting those working to strengthen the health, rights and wellbeing of all trans people – binary and non-binary. The AusPATH membership comprises over 300 experienced professionals working across Australia.

Here is the full judgment and a summary published by the Court. Here is a statement made by Mermaids UK.

We have previously detailed our concerns with regard to the original decision  in this case, which we believe seriously undermined gender affirming healthcare for trans youth in that country.  See our 29 Dec 2020 statement available at: https://auspath.org.au/auspath-statement-on-bell-v-tavistock/.

We have re-endorsed our professional commitment to the gender affirming model based on best available evidence.  See our 26 June 2021 public statement on the gender affirming model of healthcare, including for trans youth, available at: https://auspath.org/gender-affirming-healthcare.

We continue to have serious concerns regarding the implications of the re: Imogen case in the Family Court of Australia, which we believe also undermines healthcare for trans youth. See our public statement of 21 September 2020, available at: https://auspath.org.au/auspath-statement-on-medical-gender-affirmation-and-re-imogen/.

AusPATH hopes that the overturning of the original Bell v Tavistock decision in the UK may have a favourable influence on future decisions impacting healthcare for trans youth in Australia.
